What the regulations say
Since 12 May 2019, all companies in Spain have been required to record the working day of every employee, full-time or part-time, each day, with the exact start and finish times. This is set out in Spanish Royal Decree-Law 8/2019 (Real Decreto-ley 8/2019), which added section 9 to article 34 of the Workers' Statute (Estatuto de los Trabajadores). Records must be kept for four years and be available to employees, their representatives and the Labour Inspectorate.
In addition, the Spanish Government is processing a royal decree that will make it mandatory for this record to be digital, reliable and tamper-proof, with no paper sheets or spreadsheets. An automatic time and attendance system already complies with the law today and leaves the company ready for what is to come.
